For any dispute arising from or connected with this contract, the Court of Bolzano shall have exclusive jurisdiction and is expressly designated as the exclusive place of jurisdiction for the resolution of disputes connected with the relationship between the customer and Tirolix S.R.L.
The goods supplied shall remain the property of Tirolix S.R.L. until full payment of the agreed purchase price has been received.
With the publication of new offers, price lists, updates or commercial conditions on the website, any previous conditions shall be considered no longer valid.
Except in cases of material errors, printing errors, stock shortages, technical changes, manufacturer changes, force majeure or unforeseeable events, Tirolix S.R.L. reserves the right to update, modify, suspend or cancel offers, prices, availability, commercial conditions and information published on the website.
Product images, descriptions, technical characteristics and availability shown on the website are provided for information purposes only and may be subject to change without prior notice by Tirolix S.R.L. or the manufacturers. Terms and Conditions for Marketing Communications by E-mail and SMS
These terms govern the sending of commercial, promotional and informational communications by Tirolix S.R.L. via e-mail, newsletters, SMS and any other electronic channels expressly authorised by the user.
By subscribing to Tirolix S.R.L.’s marketing communication services, the user authorises Tirolix S.R.L. to send communications relating to commercial offers, promotions, product news, item availability, service updates, order-related communications, company information, promotional campaigns and content connected with professional sales activities, B2B, hotellerie, catering, restaurants, bars and hotel supplies.
Subscription to marketing communication services is voluntary. Tirolix S.R.L. sends promotional communications by e-mail and/or SMS only to users who have provided free, specific, informed and documentable consent, in accordance with the applicable legislation on personal data protection and commercial communications.
Consent to receive communications by e-mail is separate from consent to receive communications by SMS. Any consent provided for one communication channel does not automatically imply consent for other channels, unless otherwise expressly and documentably indicated by the user.
The user may choose to receive marketing communications by e-mail, by SMS or through both channels, according to the options available in the subscription forms, consent collection systems or platforms used by Tirolix S.R.L.
E-mail communications may include newsletters, commercial offers, product updates, promotional campaigns, service-related communications, stock availability, company news and informational content aimed at customers, potential customers, companies, professionals, hotels, restaurants, bars, catering companies and operators in the sector.
SMS communications may include promotional messages, commercial offers, notices relating to active campaigns, product updates, information on item availability, communications connected with orders, services and the commercial activities of Tirolix S.R.L.
The frequency of communications may vary depending on active campaigns, promotions, product availability, product updates, seasonality and the commercial activities of Tirolix S.R.L. The user acknowledges that the number of e-mails and/or SMS received may vary over time.
Any costs for receiving SMS messages, data traffic, roaming or other charges applied by the user’s telephone operator shall remain the sole responsibility of the user, according to the conditions of their telephone plan. Tirolix S.R.L. shall not be responsible for costs, charges, limitations, delays or failed delivery caused by the user’s telephone operator, device or external technical platforms.
The user may withdraw consent to receive marketing communications at any time, without affecting the lawfulness of the processing carried out before the withdrawal.
For e-mail communications, withdrawal may be carried out by using the unsubscribe link included in the communications received, where available, or by sending a request to [email protected].
For SMS communications, withdrawal may be carried out by following the instructions included in the messages received, by using any available unsubscribe functions or by sending a request to [email protected].
Following withdrawal of consent, Tirolix S.R.L. shall stop sending marketing communications through the channel affected by the withdrawal, except for any communications strictly necessary for the management of orders, quotations, pending requests, contractual relationships, administrative, tax or legal obligations.
Withdrawal of marketing consent does not prevent Tirolix S.R.L. from sending non-promotional communications necessary for the management of existing commercial relationships, orders, deliveries, payments, customer service, warranties, administrative requests, accounting obligations or legal obligations.
Tirolix S.R.L. may use external platforms, technical providers, automation systems, newsletter services, marketing tools, CRM systems or SMS and e-mail delivery platforms to manage communications. Such parties may process personal data exclusively on behalf of Tirolix S.R.L., within the limits necessary for the performance of the service and in compliance with applicable legislation.
Tirolix S.R.L. does not sell users’ personal data to third parties. Data may be communicated only to authorised parties, technical providers, consultants, message delivery platforms, marketing systems or parties operating on behalf of Tirolix S.R.L., within the limits necessary for the management of the service.
Tirolix S.R.L. reserves the right to modify, suspend, limit or discontinue marketing communication services by e-mail and SMS at any time, including for technical, commercial, regulatory, organisational reasons or reasons connected with the platforms used.
Tirolix S.R.L. does not guarantee that e-mail or SMS delivery services will always be available, uninterrupted or compatible with all e-mail providers, telephone operators, devices, countries or IT systems. Any delays, failed delivery, spam filters, technical blocks, delivery errors or problems caused by third parties shall not give rise to any liability on the part of Tirolix S.R.L.
The user is responsible for the accuracy of the data provided, including e-mail address and telephone number. Tirolix S.R.L. shall not be responsible for communications not received or received by different parties due to incorrect, incomplete, outdated or improperly provided data.
Processing of Personal Data
The personal data provided by the user, including name, surname, company name, e-mail address, telephone number, commercial preferences and data relating to interactions with communications received, may be processed by Tirolix S.R.L. for marketing purposes, commercial communication, customer management, sending offers, newsletters, SMS and updates relating to the products and services offered.
The processing of data is carried out in compliance with the applicable legislation on personal data protection, including Regulation EU 2016/679, the Italian Privacy Code and the applicable provisions on electronic communications and direct marketing.
